This privacy notice (“Privacy Policy”) applies to https://maximon.global and https://maximonglobal.com (further as “Maximon websites”), Maximon Global, mobile applications developed by Maximon Global (further as “Maximon mobile applications”), third parties and their mobile applications that integrate with Maximon Global, and governs data collection and usage. Maximon websites, Maximon mobile applications, Maximon’s electronic devices and equipment are a part of Maximon’s Platform (“platform”). By using Maximon’s Platform and third party websites, mobile applications, and devices that integrate and share data with Maximon Global, you consent to the data practices described in this privacy notice.

COLLECTION OF YOUR DATA

We may ask for and collect your data directly through our Platform or when you communicate with us in any way, or indirectly through third party partners and providers.

You may be required to provide certain personal information to us when you elect to use certain products or services available on Maximon’s Platform. We may collect certain data listed below in this Privacy Policy automatically, when you visit our Websites (see Cookie Policy), open our emails, download our Mobile Applications, use our Platform, interact with our ads.

Personal Data You Provide Us

Maximon Online Store

To create an account in our online store, and/or to make a purchase in our online store, you may be required to provide personal information such as:

1. Contact information – your first and last name, address, email address, and phone number;
2. For promotional purposes – your first and last name, birthday, address, email address, and phone number;
3. To make a purchase – your billing information such as first and the last name, address, and payment details.

By signing up for an account in our online store, or entering an event, you automatically gain access to our Platform, products, and services, where if you intend to you use it, you may be required to provide personal information such as:

1. Your first and last name, place of residence, birthday, age, and gender;
2. Your health information – height, weight, and lifestyle information.

When you interact with and/or use our Platform we may directly or indirectly collect data:

1. Information about purchase behavior – purchased items, items in the shopping cart, items in the wishlist;
2. Geographic location including your device and IP address – only if you have enabled the location services for this website on your device;
3. Call transcripts and records of customer service calls, e-mail communication with our customer service, Maximon Global website chat logs.
4. Device information during interacting with our ads (clicking on our ads), e-mails, visit our social media accounts – we collect IP address, browser information and device type information;
5. Platform behavior – pages and products you visited, button clicks, link clicks, mouse movements;

7. Health information from linked electronic devices (smart watches, fitness trackers, etc.) if you provide this information to us;
8. Health information from linked third party platforms and devices;
9. Your fitness tracking data from various fitness equipment, fitness tests, if you enter this data using our fitness analyzing tools;
10. Your fitness tracking data entered into the Platform by Maximon employee if you compete in our event.

Maximon Global’s Social Platform

We collect information and data on our social platform including:

• User generated content: photos,videos,media, and their metadata (location of the photo, date of photo’s creation); your communication to us and to other users via messaging; other content (statuses, comments); profile information, and any changes to your account preferences.
• Information about accounts, people, groups, and tags, and users’ interaction with these and other products and services across our platform;
• Information about users’ usage and engagement with Maximon’s products and services such as types of content users engage with, tools and features they use, time and frequency of users’ actions/engagement with the Platform’s products and services;
• Information about the type of content users view, so we can serve the user with relevant content;
• Information about you from other users;

HOW WE USE YOUR DATA

We use data we collect from you to:

• Improve your experience with our platform – we believe in providing relevant and personalized content and products to you according to your interests, preferences, and location so you can enjoy using our Platform;
• Improve our products and conduct further research on how we can improve our products and services, and to make sure your data is safe and secured.
• Platform troubleshooting;
• Analyze and determine your fitness level, your progress, and to make targeted and relevant suggestions for your space to improve. We may also suggest seeing a health professional if our fitness analyzing systems detect a possible health problem.
• Connect you via our Platform with a professional fitness/wellness coach if you choose to use the live coaching services;
• Help you connect with like-minded users in your area to support each other in your fitness goals;
• To share your fitness data with a health professional or fitness/wellness coach if you choose to share your fitness data for these purposes;
• Effective communication with Maximon and our customer service;
• Personalize Maximon’s marketing campaigns.

THIRD PARTIES

Maximon Global may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is transferred to the third party.

Maximon Global may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Maximon Global, and they are required to maintain the confidentiality of your information.

Maximon Global may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Maximon Global or the Platform; (b) protect and defend the rights or property of Maximon Global; and/or (c) act under exigent circumstances to protect the personal safety of users and employees of Maximon Global, or the public.

Maximon Global may receive and collect information from third parties that integrate with Maximon Global if you choose to provide this information to third parties and to Maximon. Information that integrated third parties collect are subject to their terms and policies, not ours.

Third parties may see information you decided to make public (not private or shared with Platform’s users) on your public profile.

You can opt to share your information on our Platform to provide these information to your health practitioner, other health professionals or fitness/wellness coaches.

PROTECTION OF YOUR DATA

Maximon Global secures your personal information from unauthorized access, use, or disclosure. Maximon Global uses the following methods for this purpose:

We may store your data on servers provided by third party hosting vendors with whom we have contracted.

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through this Platform cannot be guaranteed.

Right to Deletion

 Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

Delete your personal information from our records; and

Direct any service providers to delete your personal information from their records.

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

• Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

• Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
• Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
• Comply with an existing legal obligation; or
• Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

CHILDREN UNDER 13

 Maximon Global does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this Platform. 

AGE LIMIT TO ENTER OUR EVENTS

You must be 18 to enter Maximon Global’s event, otherwise you must provide parental consent to us.

OPT-OUT & UNSUBSCRIBE FROM THIRD PARTY COMMUNICATIONS

E-MAIL COMMUNICATIONS

 From time to time, Maximon Global may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from Maximon Global or click on a link therein.If you would like to stop receiving marketing or promotional communications via email from Maximon Global, you may opt out of such communications by clicking on the ‘Unsubscribe’ button on the bottom of the e-mail.

CHANGES TO THIS STATEMENT

 Maximon Global reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating any privacy information on this page. Your continued use of the Platform and/or Services available through this Platform after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
